DECREE February 27, 2020 (OJ n.92 of 7-4-2020) Application for registration in the special register of historical brands of national interest.
From 16 April 2020, it is possible to provide with the application for registration in the special register of historic brands of national interest, an application that can be submitted to the Italian Patent and Trademark Office.
The registration in the said special register, in addition to the recognition in itself of the “historical brand”, offers the opportunity to add the following symbol to your own brand…
The registration, for registered trademarks, is accompanied at least by the first filing report in Italy or by the oldest renewal report available and also by the reproduction of the copy of the trademark.
It is also possible to file the applications, even for unregistered signs or brand, accompanied by the reproduction of the copy of the trademark and the documentation, that, demonstrating actual and continuous use for at least fifty years, specifying the products and services to which we refer according to the Nice international classification. Said documentation may consist in the presentation of samples of packaging, labels, price lists, catalogs, invoices, shipping or export documents, photographs, advertisements in newspapers and written declarations and similar means.
The Office, having received the application with the documentation, carries out the examinations aimed at verifying that the trademark has been registered for at least fifty years and renewed continuously over time or, in the case of an unregistered trademark, that there is effective and continuous use for at least fifty years. If there is a lack of documentation and, in any case, where deemed necessary, it proceeds to assigning a deadline for the response.
Said step, ends within sixty days in the case of a registered trademark or within one hundred and eighty days in the case of an unregistered trademark, decides on the application for registration with a provision of acceptance or refusal.
The special register containing information on historical trademarks of national interest is published on the website www.uibm.gov.it and can be consulted on the database of industrial property and securities of the Italian Patent and Trademark Office, which takes care of them constant updating.
