Deal with intellectual property (patents and trademarks)
Since September 20, 2012, (new art. 1 DL no. N. 168/2003), the sections were increased to 21 compared to 12 existing in the field of industrial and intellectual property rights (Bari, Bologna, Catania, Florence, Genoa, Milan , Naples, Palermo, Rome, Turin, Trieste and Venice). The Company Court is therefore now established in the Courts of Appeal of each region, with the exception of Valle d’Aosta, for which is assigned the Court of Appeal of Turin and Lombardy and Sicily, which were set up additional sections, respectively Brescia and Catania.
These sections in the field of Companies, are composed of judges chosen from among magistrates with specific skills and judge in a board.
The sections in the field of business are for:
– Industrial property and unfair competition;
– Copyright;
– Agreements restricting competition, abuse of dominant position and mergers;
– Violation of antitrust laws;
– Joint-stock companies, cooperative societies and mutual insurance companies, European companies, European Cooperative Societies, “permanent establishments in the State of companies incorporated abroad,” companies that carry or are subject to management and coordination of one of these companies.
